Germany company Cybex GmbH filed law suit against Indonesian Company cybex

Germany cybex gmbh as plaintiff filed a lowsuit againts indonesian company cybex in central jakarta commercial court.The lawsuit is raised to the defendant owned by samuel hadi wiyoto because cybex is considered to have a similarity of brand with the plaintiff, germany company. 

cybex gmbh claimed that the products that are sold by the defendant cybex are precisely similar which are pram or cot. In further, the name of brand is exactly the same, the letter contained, pronounciation. While this germany company has launched its producst since 2003 and has already the international market meanwhile cybex just obtained the permit of business in 2010.
The plaintiff considered that it's disadvantageous for the company since the defendant manufactures the similar products. Moreover the intention of the defendant to ride along the popularity of products and ruining the quality of cybex germany.

Defendants have obtained similar to the trademark certificate IDM000258089 number of grade 12 and grade 20 IDM000358737 numbers are respectively registered on July 13, 2010 and February 21, 2011.

While the plaintiff filed a request for registration of the mark Cybex through the Directorate ministry of trade and Human Rights agenda D00.2015.026452 number of class 03, class D00.2015.026442 number 10 and number 12 D00.2015.026443 class.

Then, the class agenda D00.2015.026444 number 18, number 20 D00.2015.026436 class, No. D00.2015.026438 class 24, class D00.2015.026437 number 28, and number 35 J00.2015.026439 class, which all filed on June 19, 2015.
